In early August, the Government of Ukraine announced that it had adopted a decision to allow foreign companies and organizations operating in Ukraine through permanent establishments to acquire the right to carry out economic activities in the construction of facilities by filling out a declaration.

In Ukraine, the Construction Customer may be a developer at the same time, but the developer is not always the Customer of the construction project. It is the Construction Customer who has the title documents (ownership/use) for the land that is responsible for obtaining all the permits required for the design and start of construction work before obtaining a permit to put the building into operation.To date, Ukraine has a Unified State Electronic System in the field of construction (hereinafter referred to as the electronic system). All documents, from obtaining the city planning conditions and restrictions to the commissioning of the construction object, are submitted and received through the electronic system.

Pursuant to Ukrainian law, foreigners may acquire ownership of non-agricultural land plots within settlements and of non-agricultural land plots on which real estate objects belonging to them on the right of private ownership are located, outside of settlements.

Undoubtedly, investing in potentially war-torn areas involves great risks. Therefore, appropriate insurance of assets and other aspects of business activities is necessary. The Ukrainian government, as well as international organizations, are constantly working on this issue.

An important detail is that it is the debtor who can initiate the pre-trial recovery, if they have prerequisites for this: additional financing or involvement of an investor. However, for the creditor, this procedure may ensure the return of larger receivables than the bankruptcy procedure at court ,although it will need certain compromises.
